Terms and conditions of use
Article 1
Preamble
The present conditions of sale of use are concluded on the one hand by Italiagessi company, head office: Via Arginetto 87 41019 Soliera (MO) Italy (hereinafter “the seller”) and on the other hand by any individual or legal entity willing to make a purchase through the seller’s Website (hereinafter “the buyer”).
Article 2
Goods
The present conditions of sale define the contractual relationship between the seller and the buyer, as well as all conditions applicable to any purchase made through the commercial site of the seller, whether the buyer is an individual or a professional.
Acquiring goods or services through this site means that the buyer accepts the present sales conditions without reserve.
These conditions of sale will prevail over any other general or particular conditions not expressly agreed to by the seller. The seller reserves the right to modify its conditions of sale at any time. In this case, the conditions which apply will be those in force at the date of the buyer’s order.
Article 3
Products and services
The products and services offered are those figuring in the offer presented in the seller’s website. The pictures and descriptions are indications and information given by the fabricant. The pictures are as accurate as possible but cannot assure a perfect match to the offered product, especially concerning the colors. Products and services are offered according to stock availability.
If we can’t provide a part or the whole item despite our effort, the seller sends an e-mail to the buyer as soon as possible. The buyer is to choose between waiting and cancelling the unavailable products with no additional charges. The available items will be delivered normally.
Article 4
Rates
Products and services prices displayed on the website are indicated in €uros all taxes included (TVA and any other applicable tax)
However, the applicable costs to the order are the one in force at the moment of its confirmation.
The prices on the website do not include order, transport and delivery fees.
Article 5
Geographic areas
The online selling of products and services presented on the seller’s website is exclusively made for buyers residing in Italy (continental), Belgium, France (continental), Grand Duchy of Luxembourg, the Netherland, Germany and for deliveries required in these areas.
Article 6
Orders
The buyer who wishes to acquire a product or a service must:
- fill in the identification sheet with all the required information and his client number if he has one
- fill in the online order form giving all the chosen products or services references
- confirm the order after checking it
- confirm his order and rules
- make the payment under the conditions
Order confirmation means that the present sales conditions are accepted, that they have been read and understood and that the buyer renounces the possibility of applying other conditions.
All given information and saved confirmation are proofs of transaction. Confirmation is equal to a signature and acceptance of the operation effected. The seller will communicate the saved order confirmation by e-mail.
Article 7
Right of withdrawal
According to the law, the buyer has the right to notify the seller of his withdrawal on the purchase with no penalty and no indication of motives, within the 14days from the day after receiving the package or concluding service contract.
This right of withdrawal does not apply to a professional buyer.
Within this deadline, the buyer must notify his intention of withdrawal by e-mail and send the delivered package back to the factory (address: GESSO Thomas Edison av. 133 1470 Thines (Nivelles) Belgium) at his expense together with the send-back number.
